Designated agent
Our agent to receive notifications of claimed infringement, as registered with the U.S. Copyright Office:
Copyright Agent, Goonsesh LLC1209 Mountain Road Pl NE, Ste NAlbuquerque, NM 87110, USAEmail: hello@goonsesh.comThe form below reaches the same person. Notices sent by email or post are accepted the same way and count from the moment they arrive.
Filing a takedown notice
You do not need an account. Use the form (also in the ⋯ menu of every post) or send the agent a written notice that contains:
- a description of the copyrighted work you say is infringed;
- the URL of each post on Goonsesh you want removed (several are fine, one per line);
- your name, postal address, phone number and email address;
- a statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent or the law;
- a statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner of an exclusive right that is allegedly infringed or are authorized to act on the owner's behalf;
- your physical or electronic signature (your full name, typed).
What happens next
- We block the material, usually within 24 hours of receiving a complete notice.
- Blocked material is hidden from everyone, not deleted, so it can be restored if a counter-notice succeeds.
- We tell the uploader at once, in the app and by email: which post, which notice it came from and how to file a counter-notice.
- We reply to you at the email address you gave us, including when we do not act on your notice.
Counter-notices
If your post was blocked and you believe that was a mistake or a misidentification, you can file a counter-notice. Use the counter-notice form, which the notification about the block links to, or send the agent a written counter-notice that contains:
- the post that was blocked and the address it was at;
- a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification;
- your name, postal address and phone number;
- a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located or, if your address is outside the United States, for any judicial district in which Goonsesh LLC may be found, and that you will accept service of process from the person who filed the notice or their agent;
- your physical or electronic signature.
We forward the counter-notice, including your name, address and phone number, to the person who filed the notice. Unless they tell us within 10 business days that they have filed an action seeking a court order against you, we restore the material 10 to 14 business days after we receive your counter-notice, and the strike is withdrawn.
Repeat infringers
Every notice that leads us to block material is a strike against the account that uploaded it. A strike is withdrawn when the material is restored after a counter-notice, or when the notice is withdrawn. An account with 3 active strikes within 12 months is closed, and we take reasonable steps to keep the same person from opening a new one, such as blocking their email address. We may close an account sooner where the circumstances call for it.
False notices and counter-notices
Under 17 U.S.C. § 512(f), anyone who knowingly materially misrepresents that material is infringing, or that it was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees. Do not file a notice or a counter-notice unless you are sure.
When you upload
Every upload carries your confirmation that you own the content or are authorized to publish it on Goonsesh, and that publishing it does not infringe anyone's copyright. See What you post in the Terms of Service.
