Who we are

Goonsesh is operated by Goonsesh LLC, a limited liability company organized under the laws of the State of New Mexico, USA (Entity ID 0008131822). In these terms "Goonsesh", "we" and "us" mean Goonsesh LLC, and "you" means the person using the service.

By creating an account, or by using Goonsesh without one, you agree to these terms and to the Platform Rules. If you do not agree, do not use Goonsesh.

Who may use Goonsesh

• You must be at least 18 years old, or the age of majority where you live if that is higher.
• Viewing sexually explicit material must be legal for you where you are.
• Some regions are blocked from the member area because of local age-verification laws. Do not get around that block, for example with a VPN or somebody else's account.
• You may not use Goonsesh if we have banned you before, unless we have agreed to it in writing.

Your account

• Use an email address you can receive mail at, and keep your password to yourself. You are responsible for what happens under your account.
• Your @handle and profile must not impersonate anyone or infringe anyone's rights. We may change or reclaim a handle that does.
• If you think somebody else got into your account, tell us at hello@goonsesh.com.

What you post

You keep the rights you have in what you post: videos, photos, captions, comments, tags, messages and your profile.

You give Goonsesh LLC a worldwide, non-exclusive, royalty-free license to host, store, copy, transcode, display, stream and distribute that content on Goonsesh, to make thumbnails, previews and shorter clips from it, and to show it in feeds, search, the public preview for visitors who are not signed in (where your visibility settings allow it) and our own promotion of the service. The license ends when the content is deleted, except for copies we have to keep for legal reasons.

When you upload, you confirm that:

• everyone shown was at least 18 years old when it was recorded, agreed to being recorded and agreed to it being published;
• you own the content or have the right to share it here, and sharing it does not infringe anyone's copyright, privacy or other rights;
• it follows the Platform Rules, and the content flags you set (orientation and intensity) describe it accurately;
• the tags and source links you add are correct as far as you know.

We do not review everything before it appears, and we are not responsible for what members post. We may remove anything that breaks these terms, the Platform Rules or the law.

What you must not do

• Anything the Platform Rules forbid.
• Harass, threaten or expose anyone, or share somebody's private information.
• Spam, mass-message or advertise without our permission.
• Scrape, crawl or bulk-download Goonsesh, or use bots, other than through an API we offer and within its limits.
• Get around a limit we set or a choice somebody made: rate limits, region blocks, download limits, visibility settings, or a block another member placed on you.
• Run several accounts, or coordinate with others, to farm Gooncoins, votes, referrals or rankings.
• Attack, overload or reverse-engineer the service, or upload malware.
• Use Goonsesh for anything illegal.

Gooncoins, badges and Premium

• Gooncoins, badges, levels and rankings are features of the service. They have no monetary value, cannot be exchanged for money, and cannot be sold, traded or transferred outside Goonsesh.
• We decide how they are earned and spent, and we may change that at any time. We may correct balances that came from errors, abuse or content that was later removed, and a balance can go below zero.
• Premium is unlocked with Gooncoins. It is not sold for money.
• When an account is deleted, its Gooncoins, badges and Premium go with it.

Downloads and the upload API

Where Goonsesh lets you download a video, the download is for your personal, private use. Do not re-upload, share or sell it. Download limits apply.

If we give you an API key, it is for uploading your own content to your own account. Keep it secret. We may limit or revoke it at any time.

Direct messages

Direct messages are visible only to the people in the conversation, but they are not end-to-end encrypted. They are stored on our servers, and we may look at a conversation when somebody in it reports it, or when the law or somebody's safety requires it.

Moderation

We may remove or hide content, limit features, pause an account or ban it permanently if it breaks these terms, the Platform Rules or the law, or puts other people or Goonsesh at risk. Where we can, we tell you why.

You can report a post, comment, profile or message through its ⋯ menu. If you think we got a decision wrong, write to hello@goonsesh.com.

Where the law requires it, we report content to the authorities. Child sexual abuse material is reported to the National Center for Missing & Exploited Children (NCMEC).

Copyright complaints (DMCA)

We respond to copyright notices under the U.S. Digital Millennium Copyright Act. If you believe something on Goonsesh infringes your copyright, send a notice through the copyright form (in the ⋯ menu of every post and on our studios page) or by email to hello@goonsesh.com. You do not need an account.

A notice must identify the work you say is infringed and where the material is on Goonsesh, give your contact details, and state, under penalty of perjury, that you believe in good faith the use is not authorized, that the notice is accurate, and that you are the rights holder or authorized to act for them. It must carry your physical or electronic signature.

If your content was removed because of a notice and you believe that was a mistake, you can send a counter-notice to hello@goonsesh.com with the information required by 17 U.S.C. § 512(g).

We close the accounts of members who repeatedly infringe copyright.

Closing your account

You can pause or delete your account in Settings → Account. A paused account is hidden from everyone and you can restore it at any time. A deletion takes effect 30 days after you ask for it: until then you can log in and restore the account, after that it is gone for good. The Privacy Policy explains what deletion removes and what we keep.

If you want it gone sooner, write to hello@goonsesh.com from the email address on the account and we will delete it straight away.

We may suspend or close your account as described under Moderation. Sections that by their nature should survive (such as the license for content that is still on the service, the disclaimers, the limitation of liability and the governing law) keep applying after an account is closed.

Other websites

Goonsesh links to other websites, for example the source links on scenes and the links on studio and performer pages. We do not control those sites and are not responsible for them.

Changes

Goonsesh is in active development. Features change, and some may go away. We may update these terms; if a change matters, we tell you on the site or by email before it applies. If you keep using Goonsesh after that, the new terms apply. If you do not agree with them, close your account.

Disclaimers

Goonsesh is provided "as is" and "as available". To the extent the law allows, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the service will be uninterrupted, error-free or secure, or that content on it is accurate or lawful.

Limitation of liability

To the extent the law allows, Goonsesh LLC and its members, managers, employees and agents are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from or related to your use of Goonsesh. Our total liability for all claims related to Goonsesh is limited to US$100.

Some jurisdictions do not allow these limits. Where they do not, they apply only as far as the law allows.

Indemnity

If somebody brings a claim against Goonsesh LLC because of content you posted, or because you broke these terms or the law, you will cover the reasonable costs, damages and legal fees that result from that claim.

Governing law and disputes

These terms are governed by the laws of the State of New Mexico and applicable U.S. federal law, without regard to conflict-of-law rules. Any dispute goes to the state or federal courts located in Bernalillo County, New Mexico, and you and we consent to their jurisdiction.

Before you go to court, write to us at hello@goonsesh.com. Most problems are solved by email.

If you are a consumer living outside the United States, nothing here takes away protections that the mandatory law of your country gives you.

General

These terms, the Platform Rules and the Privacy Policy are the whole agreement between you and us about Goonsesh. If a part of them is found unenforceable, the rest still applies. If we do not enforce a part straight away, we have not given it up. We may transfer this agreement to a successor, for example if Goonsesh is sold or merged; you may not transfer it without our consent.
